Terms of Service
Draft for review by an attorney before OrbitWatch launches publicly. It is not legal advice.
These terms are an agreement between you and Tajuddin Moore, who operates OrbitWatch ("OrbitWatch," "we," "us"). They cover the OrbitWatch Sky web app, the OrbitWatch API, the OrbitWatch MCP server for AI assistants, and related websites (together, the "Service"). By using the Service you agree to these terms. If you don't agree, don't use the Service.
1. What OrbitWatch is
OrbitWatch shows where satellites are and predicts when they pass over a location, using publicly available orbital data. It is for information, education and enjoyment.
2. Predictions are estimates
- Satellite positions and pass times are calculated from published orbital elements, which change as satellites maneuver and as their orbits decay. Results can be off by seconds to minutes, and more as the data ages.
- Whether you can see a satellite also depends on weather, light pollution, obstructions and the satellite's orientation, which OrbitWatch cannot know.
- Antenna pointing, Doppler and pointing-table data, including CSV downloads, are estimates for hobby and educational reception. Orbit data ages, satellites maneuver, and elevation is computed without atmospheric refraction.
- Doppler figures are for receiving. Transmitting to a satellite requires an amateur radio licence or other authorisation where you are, and uplink correction has the opposite sign.
- Do not use OrbitWatch for navigation, aviation, maritime, emergency, military or safety-of-life decisions, collision avoidance, operating any spacecraft, or operating any ground station where a pointing or timing error could cause harm, loss of service or a regulatory breach.
3. Third-party information
Some features describe services offered by others, such as in-flight Wi-Fi offered by airlines. That information comes from public sources, may be out of date, and is not a promise by OrbitWatch or by those companies. Always confirm with the provider.
OrbitWatch is independent. It is not affiliated with, endorsed by, or sponsored by SpaceX, Starlink, NASA, NOAA, the China Manned Space Agency, AST SpaceMobile, CelesTrak, or any airline. Their names and marks belong to their owners and are used only to identify their satellites and services.
4. Using the Service responsibly
You agree not to:
- access parts of the Service that require an API key without an approved key, share your key, or try to get around authentication, rate limits or other protections;
- scrape, overload, attack, or disrupt the Service, or probe it for vulnerabilities (please report security issues to the contact below instead);
- use the Service to break any law, including export control and sanctions laws, or to harass, track or harm anyone;
- copy, resell, or reverse engineer the Service except as the law allows or a written agreement with us permits.
5. API keys and AI assistants
API keys are issued at our discretion, are personal to the person or organization they were issued to, and can be limited, suspended or revoked at any time, for example for misuse or excessive traffic. Keep your key secret. If an AI assistant uses OrbitWatch on your behalf through the MCP server, these terms apply to that use.
6. Paid plans
OrbitWatch does not currently sell anything. Plans and prices shown in the app are proposals. If paid plans launch, they will have their own billing terms, shown to you before you pay, and payments will be handled by a payment processor. OrbitWatch will never store your full card number.
7. Ownership
The Service, including its software, design, text and graphics, is owned by Tajuddin Moore and protected by copyright and other laws. All rights not expressly granted to you are reserved. Orbital data comes from public sources, and some components are open-source software used under their own licenses; see Credits and licenses.
8. Your feedback
If you send ideas or feedback, we may use them without owing you anything.
9. Privacy
Our Privacy Policy explains what information the Service handles. In short, your location stays on your device.
10. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. We don't promise the Service will be uninterrupted, error-free, or available in your country.
11. Limitation of liability
To the fullest extent the law allows, OrbitWatch will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $100. Some places don't allow these limits, so they may not apply to you.
12. Indemnity
If you misuse the Service or break these terms and someone makes a claim against us because of it, you agree to cover the reasonable costs of that claim, to the extent the law allows.
13. Export and sanctions
The Service uses public information, but you are responsible for complying with export control and sanctions laws that apply to you. You may not use the Service if you are located in, or are a person restricted by, a country or list subject to U.S. sanctions.
14. Changes and ending the Service
We may change these terms. If a change is significant, we will show a notice in the app before it takes effect. We may change, suspend or stop any part of the Service at any time. You may stop using it at any time.
15. Governing law
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in California, unless the law where you live gives you the right to bring a claim locally.
